1.About these terms
These Terms of Use (Terms) govern your access to and use of the HuntrStay website at huntrstay.com and any related services (together, the Platform).
HuntrStay (we, us, our) operates the Platform from South Australia. HuntrStay is currently in waitlist mode; the operating entity will be disclosed here when bookings open.
By accessing the Platform, joining the waitlist, listing a property, or making a booking request, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
You must be at least 18 years old and legally able to enter a binding contract under Australian law to use the Platform.
2.What HuntrStay is — and what it is not
HuntrStay is a marketplace intermediary. The Platform exists to connect Australian hunters with landowners who allow hunting on their properties. That's it.
HuntrStay is not:
- a property owner, occupier, host, manager, agent, or operator of any listing;
- a party to any booking, contract, agreement or arrangement formed between a hunter and a landowner;
- a hunting guide, outfitter, broker, or supplier of hunting services;
- an insurer, underwriter, or guarantor of any user, listing or transaction;
- a regulator, licensing body, or authority on firearms or hunting law;
- a law firm, legal advisor, or provider of legal services.
HuntrStay does not own, control, inspect, verify, manage, or supply any property, accommodation, hunting access, equipment, or service listed on the Platform. Listings are created and managed by landowners; bookings are arranged directly between hunters and landowners. Any contract, agreement, communication, payment or obligation arising from a booking is exclusively between the hunter and the landowner.
3.No verification of users, licences or listings
HuntrStay does not verify the identity, suitability, qualifications, licences, insurance, financial standing or character of any user. HuntrStay does not verify the accuracy, completeness, safety, legality, condition, location, ownership, or fitness for purpose of any listing, property, accommodation or hunting access advertised on the Platform.
HuntrStay does not collect, store or hold firearms licence numbers or documents. Hunters confirm the licences they hold; landowners sight the physical licences in person at check-in. The responsibility for confirming a hunter holds current and valid licences for the relevant state rests entirely with the landowner at check-in, and with the hunter at all times.
4.Hunter responsibilities
If you use the Platform as a hunter, you agree that you are solely responsible for:
- holding all current firearms licences, game licences, permits and authorisations required by the law of the state or territory in which you hunt;
- complying with all applicable laws including the relevant Firearms Act, game and wildlife legislation, road rules, biosecurity rules and council by-laws;
- your conduct, safety, decisions and the consequences of any action you take on a property;
- any property damage, injury or loss caused by you, your party or your equipment;
- obtaining and maintaining your own insurance appropriate to your activity.
5.Landowner responsibilities
If you use the Platform as a landowner, you agree that you are solely responsible for:
- having full lawful authority to allow hunting on the property listed;
- the accuracy and lawfulness of all information in your listing including species, seasons, accommodation, access and rules;
- compliance with state firearms, wildlife, accommodation, tourism and council laws applicable to your property;
- sighting and reasonably satisfying yourself as to the licences and identity of any hunter you accept at check-in;
- maintaining adequate public liability and property insurance appropriate to hosting paying guests engaged in hunting;
- the safety and condition of your property, accommodation and any access infrastructure.
6.Bookings and disputes are between users
Any booking request made through the Platform is an offer by a hunter to a landowner. Any acceptance, contract, agreement, payment, refund, cancellation, dispute or claim arising from a booking is between the hunter and the landowner directly.
HuntrStay is not a party to and has no role in resolving disputes between users. We may, in our discretion, provide reasonable assistance to users in good faith — this does not make us a party to any dispute and creates no legal obligation on us.
7.Acceptable use
You agree not to use the Platform to:
- do anything unlawful, infringe rights of others, or breach any duty;
- list a property you do not have authority to list, or misrepresent any aspect of a listing;
- misrepresent your identity, licences, qualifications, or affiliations;
- harass, threaten, defame, or harm any other user;
- circumvent the Platform to deal off-platform in a way that undermines HuntrStay (once bookings are live);
- introduce malware, scrape data, or interfere with the Platform's operation.
We may suspend or terminate your access at any time and without notice if we reasonably believe you have breached these Terms.
8.Indemnity
To the maximum extent permitted by law, you indemnify and hold harmless HuntrStay, our personnel, contractors and partners from any claim, loss, liability, cost, fine, prosecution, expense (including legal costs on a solicitor-client basis) or damage of any kind arising from or relating to:
- your use of the Platform;
- your conduct on, at, or relating to any property;
- any breach of these Terms or applicable law by you;
- any dispute or contract between you and another user;
- any inaccuracy, misrepresentation or omission in information you provide to the Platform or to another user.
9.Limitation of liability
Nothing in these Terms excludes any guarantee, right or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law where such exclusion would be void.
Subject to that, to the maximum extent permitted by law:
- the Platform is provided "as is" and "as available", without warranty of any kind, express or implied;
- HuntrStay disclaims all liability for loss, damage, injury, death, prosecution, fine or any other consequence arising from or related to: any property; any listing; any user; any booking; any hunt; any firearm; any wildlife; any failure or inaccuracy of information on the Platform; any third-party site, service or content linked to or referenced from the Platform; any interruption, error or downtime of the Platform;
- HuntrStay's total aggregate liability to you, where liability cannot lawfully be excluded, is limited to AUD $100 or, where applicable under the Australian Consumer Law, the resupply of the relevant service (at our election).
HuntrStay is not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profit, revenue, opportunity, goodwill, data, or expected income — even if HuntrStay has been advised of the possibility of such damages.
10.Termination
You may stop using the Platform at any time. We may suspend, restrict or terminate your access at any time for any reason, including but not limited to suspected breach of these Terms or applicable law.
11.Changes to these terms
We may update these Terms from time to time. The current version is always at huntrstay.com/terms. If we make material changes we will take reasonable steps to notify you (for example, an email to your waitlist address). Continued use of the Platform after a change means you accept the updated Terms.
12.Governing law
These Terms are governed by the laws of South Australia, Australia. You and HuntrStay submit to the exclusive jurisdiction of the courts of South Australia and the federal courts of Australia sitting in Adelaide.
